Bush pushes the envelope on Executive Privilege

They are really running scared with this newest reaction to Congress’s threat of contempt charges regarding the firing of the USA’s. BushCo said flat out that the Justice Department will never be allowed to pursue contempt charges initiated by Congress against White House officials once the president has invoked executive privilege. Per a WaPo article out this morning a senior official has stated:

“A U.S. attorney would not be permitted to bring contempt charges or convene a grand jury in an executive privilege case,” said a senior official, who said his remarks reflect a consensus within the administration. “And a U.S. attorney wouldn’t be permitted to argue against the reasoned legal opinion that the Justice Department provided. No one should expect that to happen.”

This is outrageous. This is pure unadulterated bullshit my dear reader. BushCo is saying that Exec. Priv trumps everything. That he makes the rules and Congress has no authority.

And it doesn’t trump everything..no sirree.. Not in the commission of a crime. Not in a free Democracy and not in the United States of America. He isn’t a king and he certainly isn’t Hitler..although you might get an argument from me about George being a reincarnated version of da fuhrer.

I have been waiting for ‘this other shoe’ to drop since I wrote this piece Wednesday about Executive Privilege. I knew that Bush and his minions would not sit still for contempt charges being brought by the Justice Dept.

Surely you, my dear reader, didn’t either. A final quote from the WaPo writeup:

But Stanley Brand, who was the Democratic House counsel during the Burford case, said the administration’s legal view “turns the constitutional enforcement process on its head. They are saying they will always place a claim of presidential privilege without any judicial determination above a congressional demand for evidence — without any basis in law.” Brand said the position is essentially telling Congress: “Because we control the enforcement process, we are going to thumb our nose at you.”

The shit is about to hit the fan. I just hope the Congress is ready for it. Its not going to be a cakewalk..and they better not pussy out on this.

About Dusty, hells most vocal bitch

  1. Power of the purse, baby! It’s all Congress has left. Withold the DoJ’s funding. NOW!

  2. They have more than that..if they so choose to use it. They need to visit “Nutz R Us” first however.

  3. Well I hope all these fucking idiots think the same thing with Hillary or Obama wins in 2008. when I am President, I will use executive privilege to keep the identity of my hook up secret. Air Force 1 does not go through Customs when it returns to the USA from the Amsterdam Airport. Just saying.

  4. Thats a main point I think is lost on the Rethugs Lazy..that the next President will have the same authority as Bush..and god help them repubes when its a Democrat.

  5. Well, seems to me if the Justice Department will not cooperate with the Congress, then they need to move onto a procedure that does not <>require<> the Justice Department, i.e., IMPEACHMENT!I’m not holding my breath though, too many pussies (or puppets) in the Capital.

  6. Dave, those worthless Shitstains that run the Democratic party don’t have the nads for THAT move. But they better use the historic tools given to them by our founding fathers.

  7. Apparently I hit this one late Dusty (who can keep up any more?). But wait…there’s more! C’mon over…might as well join me in my misery.

  8. Congress can charge people with contempt without going through the Justice Dept., as John Dean has pointed out. Also, any Justice Dept. official that refused to act on contempt citations in this case would be committing obstruction of justice. I don’t think the statute of limitations for that crime would be over before Bush leaves office.

  9. libhom, both Dean and Jon Turley have pointed it out..yet the fucking dems keep dragging their heels. They have now given BushCO an extension on responding..TOTAL BULLSHIT!

  10. Bush went beyond Nixon in his claims of unfettered authority practically on day one of his administration. He has now surpassed King George III, whose behaviour sparked the first American Revolution. Don’t wait for the Democrats to fix this any time soon, their complacency has become complicity long ago too. That bullshit meter you have in your sidebar must be a heavy duty model. Mine burnt out quite a while ago.

  11. S.B.T; I will turn blue and die if I expect anything out of this Congress. Bush seems to know they won’t do shit. Why is that?<>The precident being set here is one of a Congress sitting on its friggin hands m’dear inspite of a President, now Ruler, that blatantly ignores the rule of law from every single angle.<>

  12. Ps..the bullshit meter is a Chernobyl version..obviously it can take a lot before it melts down..but when it does..all hell’s gonna break loose.
